John M (Jack) Costello Passes Away

One of the Firm's founders, John M (Jack) Costello, passed away on March 23, 2007. Jack was born August 13, 1923, in Rapid City, the first child of LeRoy and Doris (Penrose) Costello. Jack's early years were spent on the family ranches at Imlay (near the Badlands) and north of Rapid City along Elk Creek. Portions of each summer season were spent with his father, herding cattle from outlying ranches to summer pastures in the Black Hills and "putting up hay" at pastures on Elk Creek ranch. The family moved to Rapid City and Jack graduated from Rapid City High School.



Jack served his country for three years during the Second World War aboard the USS FLUSSER, and obtained an Honorable discharge in 1946. Upon his return, he was united in marriage to Betty Lou Mabbot. They were blessed with three children.



In 1950, Jack obtained his Law Degree from Creighton University. Jack was State Chairman of Fraternity Phi Delta Phi.



Jack's legal profession started as City Attorney for Rapid City in early 1950s followed by private practice in the partnership of Handley, Costello & Porter, now known as Costello, Porter, Hill, Heisterkamp, Bushnell & Carpenter LLP. Jack was a member of the Defense Research Institute (1964-65) and a member of the Pennington County & American Bar Associations, as well as The State Bar of South Dakota (member Board of Bar Commissioners, 1953-56). He was also a member of the International Association of Defense Counsel, Association of Trial Lawyers of America, American Board of Trial Advocates, and American College of Trial Lawyers.



Jack had a very lengthy and rewarding legal career spanning nearly four decades. His local involvements included serving on Board of Trustees for Bennett Clarkson Memorial Hospital, Board of Directors of the Rapid City Club for Boys and Grand Ruler of The Elks Club and the Naja Shriners.



Survivors include his daughters Kathy (Dan) Staton, Susan (Dennis) Hammond, son John M Jr. (Julie) Costello, all of Rapid City; Grandchildren Brad (Kathy) Staton, Susan (Corey) McLaughlin, Debbie (Andy) Anderson, Brian (Michele) Staton, Scott (Christie) Hammond, Jeff Hammond, Johnny & Jessica Costello and eleven great-grandchildren. He is also survived by his brother Tom Costello of Costa Rica and several nieces and nephews. Jack was preceded in death by his wife Betty, his parents LeRoy & Doris and his sister and brother in law, Patricia (Joe) Trompeter.
