Supreme Court Win for Don Porter
April 8, 2009

In a case handled by Don Porter and Steve Hoffman, the South Dakota Supreme Court affirmed the right of a construction company to have local trade custom and usage considered by a jury in determining whether or not it had acted reasonably in storing sheetrock on edge at a residential home construction project. The Court's ruling upheld a defense verdict for the construction company at a jury trial in Rapid City, South Dakota, involving an injury caused by the sheetrock falling over on the plaintiff.
