Heather Bogard Arguing Before the 8th Circuit Court of Appeals

On Friday, March 24, Heather Bogard will be arguing before the 8th Circuit Court of Appeals in Grand Forks, North Dakota, at the University of North Dakota School of Law regarding a habeus corpus case titled "Engesser v. Dooley." Facts: Engesser and a woman were involved in a high speed accident, which resulted in the woman's death. The main question at trial was the identity of the driver - Engesser or the woman. Engesser was convicted of vehicular homicide and vehicular battery. Issues on appeal: whether the State violated Engesser's constitutional rights by introducing opinion evidence from a law enforcement officer on Engesser's credibility and whether the State violated Engesser's 4th Amendment Right by seizing his blood at the hospital without a warrant.
